PLATFORM TERMS · DEVELOPMENT DRAFT
A clear scope
for every permission.
1. The service
PersoTakt records requests and permissions for adult people's likenesses in AI-generated media. It stores source photos privately, delivers paid requests, records decisions and supports finished-output review. It does not generate the avatar or media itself in this version, collect likeness fees or distribute payments between the parties.
2. Accounts and identity
Account holders must be at least 18. Use accurate information and only your own identity and photographs. Company representatives must have authority. Verification must be completed before marketplace access or profile publication. A review is a check of stated evidence, not a guarantee against fraud. Do not create profiles impersonating celebrities or other people.
3. Specific permissions
Account creation and photo upload do not grant a general licence. Catalogue portrait publication is separate from private source processing and each individual licence. The submitted brief defines the project, category, script, outputs, media, countries, dates, AI tools, third parties, training scope, exclusivity and review requirement. An owner accepts or declines that exact version. Broader or different uses require a new agreement.
Owners must have the right to provide both their likeness and the photographs. Permission to use a face does not automatically cover a photographer's copyright, a person's voice, brands, music or any other third-party rights. Explicit consent for identity processing is also distinct from a commercial licence.
4. The €5 submission fee
The one-time platform fee is €5.00 in EUR for submitting one request to the selected person. The fee does not guarantee acceptance, a response or source access. The likeness fee is separate. Requests affected by platform failure or non-delivery are subject to refund review; mandatory consumer rights remain unaffected. The final service-delivery definition, refund handling and timing must be approved before public paid launch.
5. Direct likeness payment
The owner and requester arrange the likeness payment directly. PersoTakt records each party's confirmation but does not prove that an external payment occurred. Both confirmations are required before source access. Fixed, per-output and revenue-share offers must be read with the accepted project scope. Revenue-share reporting, payment dates and verification of revenue require a separate clear agreement.
6. Finished work and approval
Requesters upload each finished output. Where prior review is required, publication permission is conditional on approval of that exact version. Changed files create a new version requiring its own review. Approval is limited to the accepted licence and dates. The platform cannot technically prevent someone from publishing downloaded material elsewhere.
7. Lawful and accurate use
Do not use material for unlawful impersonation, harmful deception or uses outside permission. Requesters are responsible for required disclosure of qualifying artificially generated content, applicable advertising rules and third-party rights. Likeness permission does not establish that the real person experienced a product or made a real statement. Political and other regulated uses require their own legal assessment; this development build is not a clearance service.
8. Reports and platform action
Use the public report form to identify suspected illegal content or misuse precisely. We record reports for human review. We do not search the entire internet, determine infringement automatically or impose fines. Applicable platform duties still apply. Any legal action between parties is separate. The production notice-and-action process must include the required review, response and reasons.
9. Withdrawal, expiry and deletion
Consumer withdrawal from the platform service is separate from changing a likeness licence or withdrawing data-processing consent. See the withdrawal information. Expired or suspended permissions stop future downloads, but cannot retrieve files already downloaded. Licence consequences, cancellation and retention require case-specific review.
10. Contact and governing terms
Contact hello@webtakt.ai. Final contract formation, liability, dispute resolution and applicable mandatory consumer protections remain under review. This draft must not be presented as a completed legal compliance assessment.
